What Can We Learn About the US Supreme Court Declining to Decide Gay Marriage?

On October 6, 2014, the US Supreme Court declined to enter the gay marriage debate.  In doing so, the US Supreme Court allowed the decisions of three federal circuit courts to remain in effect.  By declining this review, gay marriage will now become legal in 11 states.

The US Supreme Court could certainly enter the gay marriage debate at a future date.  Could it be that the US Supreme Court is looking for a better or different “test case?”  Or was the US Supreme Court sending a message that the federal circuit courts were correct in their rulings?  Time will tell.

There are likely to be gay marriage challenges in other federal circuits.  If another circuit upholds a state ban, I think there is a very good chance that the US Supreme Court will take up the issue.
